For 35 years I practiced labor and employment law. My practice covered the whole range of labor and employee relations law, from traditional National Labor Relations Board work to gender, racial, religious, age and disability discrimination and harassment litigation. I also spend a significant amount of my time handling claims under the Fair Labor Standards Act. I have tried numerous employment related cases in the state courts of Massachusetts, Michigan, Illinois, California and Arizona. I also tried to verdict both class and individual employment discrimination cases in the federal courts of Texas, Illinois, Louisiana, California, Kansas, New York and Nevada, among others. I won the vast majority of cases that I tried. Some of my significant victories included a wage and hour class in which the plaintiffs sought damages in excess of $200 million dollars, defeating a class action in a gender discrimination lawsuit where the plaintiffs sought over $65 million and an individual gender discrimination claim in which the plaintiff sought $12 million in damages. I have also worked with various clients in designing and implementing, employee handbooks, pay programs, performance evaluation programs, job classifications, affirmative action plans, diversity initiatives, and minority and female outreach programs that are consistent with federal guidelines. I have also worked with various clients to insure compliance with state and federal guidelines concerning whether employees should be paid as hourly or salaried. I have also spent considerable time drafting and litigating employment agreements which include non compete agreements that seek to protect trade secrets or unfair competition by former employees. I have also presented numerous seminars and training modules on wage and hour issues, anti-harassment, diversity and inclusion to both clients and industry groups. In addition to an active practice, for five years I was an adjunct professor at the University of Chicago Graduate School of Business where I taught employment law to MBA candidates.
